Class Action

A class action is simply a procedural mechanism that has been created by the Courts to make it feasible for individual cases to be brought together at one time as a "class" where it would not be feasible or practical for the cases to be brought individually (or one at time).

For example: if a credit card company steals one dollar a month from 1 million people, then they have stolen 12 million dollars that year; however, it is not feasible or practical for any of the 1 million people to bring individual lawsuits to recover only 12 dollars each. A class action allows all 1 million people to be brought together into one case or "class" to attempt to recover the 12 million dollars that was stolen by the credit card company.

In class actions, the common complaint is that the lawyers are the only ones to make any money. Yes, believe it or not, the lawyers are in it to make money; however, it is also true that the only way the credit card company will ever be held responsible for stealing the 12 million dollars is if their is an incentive for the clients and lawyers to recover the money. Without the class action procedure, big business is free to steal at will from consumers without any fear of accountability.
